Logistics Partner & Delivery Liability Policy

At The Chain Club (“TCC”, “we”, “us”, or “our”), we work with independent third-party logistics and courier service providers to deliver orders placed through our website.
By placing an order with The Chain Club, you acknowledge and agree to the following terms regarding delivery and logistics services.
1. Independent Logistics Partners
The Chain Club does not directly employ, own, control, or operate the courier personnel responsible for delivering your order.
Orders may be handed over to independent third-party logistics companies, courier companies, delivery partners, or their respective personnel (“Logistics Partner”).
The Logistics Partner is a separate legal entity and is independently responsible for its own employees, delivery personnel, agents, operations, conduct, policies, and performance.
2. Responsibility After Handover
Once your order has been properly packed, dispatched, and handed over to the Logistics Partner, the physical transportation and delivery of the parcel are performed by that independent third-party service provider.
Accordingly, The Chain Club shall not be responsible or liable, to the maximum extent permitted under applicable Indian law, for any independent act, omission, misconduct, negligence, delay, miscommunication, operational failure, or conduct of the Logistics Partner or its personnel that is outside The Chain Club's reasonable control.
This may include, without limitation:

Delays caused by the Logistics Partner;

Failed or attempted delivery;

Incorrect delivery attempts;

Misconduct or inappropriate behaviour by delivery personnel;

Unprofessional communication by delivery personnel;

Changes to delivery schedules made by the Logistics Partner;

Incorrect tracking updates;

Routing or operational decisions made by the Logistics Partner;

Delivery attempts made outside the estimated delivery window;

Temporary logistics disruptions;
-
Weather, transportation, strikes, operational disruptions, or other circumstances beyond our reasonable control.
Nothing in this clause shall be interpreted as excluding or limiting any liability that cannot legally be excluded or limited under applicable Indian law.
3. Our Commitment to Customers
Although the Logistics Partner is an independent third party, The Chain Club genuinely values every customer and will make reasonable efforts to assist with genuine delivery-related complaints.

Where reasonably possible, we may communicate with the Logistics Partner, raise a complaint, request an investigation, provide tracking information, or otherwise assist in seeking a resolution.
However, any resolution involving the Logistics Partner remains subject to the policies, procedures, investigation, and operational control of that independent service provider.
4. No Guarantee of Exact Delivery Date
Any delivery timeframe displayed on our website, checkout page, order confirmation, or communication is an estimated delivery timeframe unless expressly stated otherwise.
We aim to dispatch and deliver orders as quickly as reasonably possible. However, delivery may occasionally take longer due to circumstances beyond our reasonable control.
Such circumstances may include courier delays, weather conditions, natural events, transportation disruptions, strikes, public holidays, address-related issues, incorrect contact information, failed delivery attempts, regulatory restrictions, or other unforeseen circumstances.
5. Delivery Address & Customer Cooperation
Customers are responsible for providing accurate and complete delivery information, including their name, address, PIN code, phone number, and other information reasonably required for successful delivery.
The Chain Club shall not be responsible for delivery problems caused by inaccurate, incomplete, or incorrect information provided by the customer.
Where a delivery attempt fails because of customer-provided information, refusal to accept the parcel, inability to receive the parcel, or repeated unsuccessful delivery attempts, additional delivery arrangements may be subject to the applicable circumstances and courier policies.
6. Damage, Tampering or Missing Items
If a parcel appears visibly damaged, opened, tampered with, or materially compromised at the time of delivery, customers should, wherever reasonably possible, record an unboxing/opening video from the moment the sealed parcel is received.
For claims involving damaged, missing, incorrect, or materially defective products, The Chain Club may request photographs, videos, packaging information, shipping labels, or other evidence reasonably necessary to investigate the claim.
The absence of an unboxing video may make it significantly more difficult for us to establish whether damage or loss occurred before, during, or after delivery. Accordingly, claims may be subject to our Refund and Replacement Policy and applicable consumer law.
7. Third-Party Conduct
The Chain Club does not authorise, endorse, or condone inappropriate, abusive, threatening, discriminatory, fraudulent, or otherwise unlawful conduct by any Logistics Partner or delivery personnel.
If a customer experiences such conduct, we request that they immediately inform us with relevant details so that we can, where reasonably possible, raise the matter with the concerned Logistics Partner.
The actions of an independent Logistics Partner or its personnel do not constitute actions authorised by The Chain Club unless expressly authorised by The Chain Club.
8. Limitation of Liability
To the maximum extent permitted by applicable law, The Chain Club shall not be liable for losses, inconvenience, delays, costs, damages, or consequences arising solely from the independent acts or omissions of a third-party Logistics Partner after the order has been handed over to such Logistics Partner and where such matter is outside The Chain Club's reasonable control.
However, nothing contained in this policy shall:

exclude or restrict any consumer right that cannot legally be excluded or restricted;

exclude liability for matters caused directly by The Chain Club's own unlawful acts, negligence, fraud, wilful misconduct, or breach of obligations imposed by applicable law;

prevent a customer from exercising any statutory rights or remedies available under applicable Indian law; or
-
prevent a competent authority, consumer commission, court, or other legally authorised body from determining liability in accordance with applicable law.
9. Assistance Does Not Constitute Admission of Liability
Any assistance provided by The Chain Club in contacting, communicating with, or raising a complaint against a Logistics Partner shall not, by itself, constitute an admission of liability, fault, negligence, or responsibility on the part of The Chain Club.
Our assistance is provided as a customer-service measure and does not alter the independent legal status of the Logistics Partner.
10. Governing Law
This policy shall be governed by and interpreted in accordance with the laws of India.
Nothing in this policy is intended to take away or restrict any mandatory rights or remedies available to consumers under applicable Indian law.
If any provision of this policy is found to be invalid, unlawful, or unenforceable by a competent authority, the remaining provisions shall continue to remain in effect to the extent permitted by law.
